1. Acceptance of Terms

By accessing or using the ONIM platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you are at least 18 years of age.

2. Description of Service

ONIM is a social platform that enables users to connect, communicate, book services, stream content, and engage in commercial transactions. The Service includes but is not limited to:

  • User profiles and discovery features
  • Messaging and communication tools
  • Live streaming capabilities
  • Service booking and scheduling
  • Digital product marketplace
  • Virtual currency (Points) system
  • Creator subscription features

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Keep your password secure and confidential
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use of your account

4. User Conduct

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Harass, abuse, threaten, or intimidate other users
  • Post or transmit content that is obscene, offensive, or promotes hate
  • Impersonate any person or entity
  • Use automated systems or bots to access the Service
  • Attempt to gain unauthorized access to other accounts or systems
  • Interfere with or disrupt the Service or servers
  • Upload viruses or malicious code
  • Spam or send unsolicited communications
  • Engage in fraud or deceptive practices

5. Content Ownership and License

Your Content

You retain ownership of content you create and share on the Service. By posting content, you grant ONIM a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and promoting the Service.

Platform Content

The Service and its original content, features, and functionality are owned by ONIM and are protected by international copyright, trademark, and other intellectual property laws.

6. Points and Virtual Currency

The Service uses a virtual currency system ("Points"). You acknowledge that:

  • Points have no real-world monetary value outside the platform
  • Points cannot be exchanged for cash except through approved withdrawal processes
  • Points may be earned through various activities or purchased
  • We reserve the right to modify Point values, earning rates, and redemption options
  • Points may expire if your account is inactive for extended periods
  • Fraudulent acquisition of Points will result in account termination

7. Payments and Transactions

When making purchases or receiving payments through the Service:

  • All payments are processed through secure third-party payment providers
  • You are responsible for any fees charged by payment providers
  • Refunds are handled according to our Refund Policy
  • Creator payouts are subject to platform fees (typically 20%)
  • You are responsible for any applicable taxes on your earnings

8. Bookings and Services

When booking services from creators:

  • Bookings are agreements between you and the service provider
  • ONIM acts as a platform facilitator, not a party to the service agreement
  • Disputes must be filed within 72 hours of service completion
  • Reviews must be submitted within 14 days of service completion
  • Cancellation policies are set by individual service providers

9. Content Moderation

We reserve the right to:

  • Review, modify, or remove any content that violates these Terms
  • Suspend or terminate accounts that violate our policies
  • Report illegal activity to appropriate authorities
  • Implement automated content filtering systems

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

We are not responsible for:

  • The conduct of any users on or off the platform
  • The quality of services provided by creators
  • Any content posted by users
  • Loss or damage resulting from your use of the Service

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONIM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

13. Indemnification

You agree to indemnify and hold harmless ONIM, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

14. Termination

We may terminate or suspend your account at any time for any reason, including violation of these Terms. Upon termination:

  • Your right to use the Service immediately ceases
  • We may delete your account data after a reasonable period
  • Pending payouts may be forfeited if termination is due to fraud

15. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law provisions.

17. Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in Accra, Ghana.
